Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Wydefire website and application (the "Service"), operated by Etsnaut LLC ("Etsnaut," "Wydefire," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance & eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms, and "you" refers to that business.

2. The Service

Wydefire provides software to help TikTok Shop sellers run creator programs — including creator discovery, outreach, content workflows, relationship management, viral amplification, and advertising support, integrated with third-party platforms through their official APIs. The Service is currently offered on a beta and evolving basis; features may change, be added, or be removed.

3. Accounts

You are responsible for your account credentials and for all activity under your account. Keep your credentials confidential and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions & billing

Paid plans are billed in advance on a recurring basis (monthly or annual) at the rates published on our pricing page or agreed in writing. Free trials, where offered, convert to paid plans unless cancelled before the trial ends. Fees are non-refundable except as required by law or expressly stated. We may change pricing prospectively with notice; beta and founding-customer pricing, where offered, applies as described at sign-up.

6. Third-party platforms

The Service integrates with third-party platforms, including TikTok and TikTok Shop. Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them. By connecting an account, you authorize us to access and act on data and perform actions on your behalf through official APIs, within the scope you grant. You are solely responsible for your communications, campaigns, disclosures, and compliance (including advertising, FTC, and platform disclosure requirements). We are not responsible for changes to, or the availability of, third-party platforms or APIs.

7. Your data

You retain ownership of the data you submit or authorize us to access ("Customer Data"). You grant us a non-exclusive license to host, process, and use Customer Data as necessary to provide and improve the Service and as described in our Privacy Policy. You represent that you have the rights and permissions necessary to provide Customer Data and to authorize the access and actions we perform on your behalf.

8. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by Etsnaut and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, modify, distribute, or create derivative works except as permitted by these Terms.

The Service uses AI to generate drafts, recommendations, and other output. AI output may contain errors or inaccuracies and is provided "as is." You are responsible for reviewing, editing, and approving AI-generated content before use, and for ensuring it complies with applicable laws and platform policies.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL PRODUCE ANY PARTICULAR BUSINESS RESULT, GMV, OR CAMPAIGN OUTCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETSNAUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Etsnaut and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, your communications with creators or third parties, or your violation of these Terms or applicable law.

13. Term & termination

These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or create risk or legal exposure. Upon termination, your right to use the Service ends; certain provisions (including Sections 7–12 and 14) survive. You may export or request deletion of Customer Data as described in our Privacy Policy.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute, and you consent to their jurisdiction and venue, except where applicable law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
